Study and Expert Fund for the Development of a Conflict Resolution Mechanism in the Financial Sector.
Since 1991, the financial sector in Kyrgyzstan underwent a series of reforms to meet the needs and demands of the free market. The microfinance sector flourished by extensively offering small loans to the Kyrgyz population, which has led to the increase in access to finance for most of the population. There are new challenges and problems arising with the increase of both the credit portfolio and the number of borrowers in the country. Many of the borrowers’ face difficulties in settlement of debts to the financial institutions. Low level of income, lack of financial knowledge among the population, lack of independent and fair mechanism resolve differences, and the low level of financial responsibility amid the financial institutions are a few among many reasons that make financial consumers vulnerable.
The National Bank of the Kyrgyz Republic, as a regulator of commercial banks, microfinance organizations, credit unions and exchange offices in the country, has created a consumer’s right protection department to facilitate consumers’ complaints. It has developed a series of regulatory documents and made changes to legislations to ensure fair and ethical conduct towards consumers. The Parliament has initiated and approved the law on Usury according to which the interest rate for loans is restricted in case of litigation, easing the pressure on consumers.
Unfortunately, these actions are not enough to facilitate independent and fair resolution of disputes among users and providers of financial services. Bearing this challenge in mind, the National Bank of the Kyrgyz Republic with the support of the German Development Cooperation have initiated an Expert Study Fund Measure to empower the vulnerable financial service consumers to access an independent, impartial and an affordable system for complaint and dispute resolution in the form of a Financial Ombudsman.
a. Study the most effective mechanisms on complaint and dispute resolution in other countries through workshops and experience exchanges.
b. Develop a funding mechanism for the Ombudsman scheme together with the working group based on analysis of current cost for dealing with complaints, budgetary processes, governance and assessment of the current situation of the financial service providers in terms of their asset size, financial stability and service coverage.
c. Negotiate and agree on a common understanding of the scheme with financial providers, and later with the government and the parliament through meetings, round tables and discussion on the introduction of an Ombudsman Scheme
d. Undertake public discussions to include the consumers’ perspective and ideas into the concept.
e. Finalize the Draft law and other supporting regulation documents based on agreed final concept of a Financial Ombudsman institute and submitted for approval to the government and the parliament at the end
a. Support the development of the strategic development plan for the implementation of the Ombudsman scheme, with clear definitions on:
b. Identify pilot capacity building services for the Ombudsman scheme and design capacity development plan including needed skills and expertise for each field.
c. Identify and manage short-term expert assignments, where needed, incl. preparing the ToR, overseeing contracts and supervise expert assignemnts with relevant reporting.
d. Develop and design information dissemination strategy for the services of Ombudsman
e. In coordination with line manager conduct active networking activities with other state institutions as well and international donors and projects to create solid partnerships in support of the introduction of the financial ombusman system in Kyrgyzstan.
The incumbent national advisor (band 4) will report directly to the Deputy Programme Manager of the German Development Cooperation implemented Sustainable Economic Development Programme in Kyrgyzstan.
